Thank you for your interest in BoxCast Inc. (hereinafter, “BoxCast”, “we” or “us”). This Privacy Policy sets forth the terms and conditions with respect to how BoxCast processes personal information about you and other third parties.

This Privacy Policy describes, among other things, the types of personal information that we collect, the purposes for which we use it, the types of third parties with whom we share it, and any rights and responsibilities you may have with respect to such personal information.

This Privacy Policy applies to the personal information you provide us when you visit any website or mobile application that we own, license, or otherwise operate and that links to this Privacy Policy, including but not limited to www.boxcast.com and the Broadcaster mobile application (each, a “Site”), purchase or receive services from BoxCast, apply for a job with BoxCast, or otherwise contact or engage with us. For purposes of this Privacy Policy, the Sites and services furnished by BoxCast shall be referred to collectively as the “Services.”

BY ACCESSING OR USING THE SERVICES OR OTHERWISE PROVIDING US WITH PERSONAL INFORMATION, YOU ARE CONSENTING TO THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT USE THE SERVICES, AND YOU SHOULD LEAVE THE SITE IMMEDIATELY AND NOT PROVIDE US WITH ANY PERSONAL INFORMATION. THE SERVICES ARE INTENDED FOR USERS LOCATED IN THE UNITED STATES AND YOUR INFORMATION WILL BE PROCESSED AND STORED IN THE UNITED STATES. WE MAKE NO REPRESENTATION THAT THE SERVICES ARE APPROPRIATE OR AVAILABLE FOR USE OUTSIDE THE UNITED STATES. 1. CHILDREN’S PRIVACY:

The Services are not directed at, nor intended for use by, children. As a result, if you are under the age of eighteen (18), you are prohibited from accessing or using the Services (including the Site) or from providing us with your personal information. If we learn we have collected or received personal information from a child under 18, we will delete that information. If you believe we might have any information from a child under 18, please contact us at optout@boxcast.com. If you upload any information about a child under 18, including their image or likeness, you expressly represent that you are or have the express consent of the child’s parent or guardian to upload the information in accordance with this Privacy Policy.

2. TYPE OF INFORMATION COLLECTED:

Information You Provide to Us

When you chat with a BoxCast Representative, create an account, use the Services, view a video stream, or otherwise interact with the Services, you may provide certain personal information to us. This may include name, username, email address, city, state, and or other personal information. If you contact us, we collect records of your correspondence (including email addresses). If you are using the Services on your mobile device, you may provide us with location data. If you use the Services to record a photograph or a video, you may provide us with access to your camera. We may also collect information that you provide when you complete a transaction on our Site. BoxCast uses Stripe, a secure payment provider, to process your payments if you purchase products or services. Your payment information is subject to the privacy policy and terms of use of Stripe. We recommend you review these policies before uploading any credit card information. BoxCast does not have access to your credit card information and does not store this information on our servers.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns. BoxCast collects information of the sort that web browsers and servers typically make available, such as traffic data, log data, crash data, language preference, referring site, and the communication data and resources that you access and use on the Site. BoxCast may also collect information about your device and internet connection, including your Internet Protocol (IP) addresses, operating system, device settings, and browser type. BoxCast’s purpose in collecting such information is to better understand how BoxCast’s visitors use the Services, to personalize and improve our Site, and to help identify spam. We also may use these technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking). Whether we collect some or all of this information often depends on what type of device you’re using and its settings. To learn more about the information your device makes available to us, please review the policies of your device manufacturer or software provider.

The technologies we use for automatic data collection may include “cookies”, web beacons or “flash cookies”. A cookie is a small file placed on your smartphone or other device. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone or device. However, if you select this setting, some parts of the Site may become inaccessible or not function properly. In addition, the Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to analyze data on your use of the Site (e.g., recording the popularity of certain content and verifying system and server integrity). Certain features of our Site may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Site. Flash cookies are not managed by the same browser settings as are used for browser cookies. Pages of our Site may contain web beacons that permit BoxCast, for example, to count users who have visited those pages and for other related site statistics (for example, recording the popularity of certain content and verifying system and server integrity).

We may tie this information to personal information about you that we collect from other sources, or that you provide to us.

Site Monitoring. Please be aware that we, and our service providers and partners, use cookies and other tracking technologies within the Site to monitor and record any and all activities and communications to, from, and on, the Site. For the avoidance of doubt, you hereby acknowledge, agree, and consent to, such monitoring and recording by us and our service providers and partners.

Information from Other Sources

We may obtain information from third parties and sources other than BoxCast, such as social media or social network platforms for which you have explicitly connected to BoxCast (e.g., information from YouTube using YouTube API Services or any other platform BoxCast connects with). When you connect your social media or social network account to BoxCast, you authorize BoxCast to collect, store and use such information and content in accordance with this Privacy Policy. Please refer to the privacy policy of the social media or social network platforms you use with BoxCast for more information about how such third party sites process your personal information. If we combine or associate information from other sources with personal information that we collect through BoxCast, we will treat the combined information as personal information in accordance with this Privacy Policy. In particular, we may obtain information from the following third party sources:

YouTube - Google Privacy Policy, If you have connected your YouTube account to your BoxCast account via the YouTube API, you may revoke access to your data via the Google security settings available here.

Our Use of Web Analytics

We use different analytic tools which serve the purpose of measuring, analyzing, and optimizing our marketing measures and provide you with customized advertisements that could be of particular interest to you. In particular, we may use the following tools:

Google Analytics uses cookies which enable an analysis of your use of the Sites. The information collected (IP address, browsing activities and other data linked to your usage of the Sites) is usually transferred to a Google server in the USA and stored there. You can prevent Google Analytics from recognizing you on return visits to a site by disabling cookies on your browser. YouTube video widget (Google Inc.) is a video content visualization service provided by Google Inc. that allows the Sites to incorporate video content.
Vimeo video (Vimeo, LLC) is a video content visualization service provided by Vimeo, LLC that allows the Sites to incorporate certain video content.

3. CHOICES ABOUT DATA DISCLOSURES:

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking in Broadcaster App. You may turn off tracking in the Broadcaster app by accessing your phone settings, clicking on Broadcaster, and using the toggle button to set "Allow tracking" to disabled.
Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of the Sites may then be inaccessible or not function properly.
Promotional Offers from BoxCast. If you do not wish to have your information used by BoxCast to promote our own or third parties’ products or services, you can opt-out by choosing to unsubscribe from communication at the bottom of emails from BoxCast or sending an email to optout@boxcast.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. The foregoing unsubscribe option does not apply to communications from BoxCast or third parties in connection with your use of the Services, such as a result of a product purchase, warranty registration, product service experience, subscription purchase, or other transactions.

4. HOW WE USE YOU INFORMATION; PURPOSE OF COLLECTION:

We use the information we collect to provide you full access and functionality of the Services. Accordingly, your information may be used for the following purposes to: (i) provide, improve, operate, maintain and promote our Services; (ii) enable you to access and use our Services; (iii) enable users to enjoy and easily navigate the Sites; (iv) better understand your needs and interests; (v) fulfill requests or to respond to questions or comments you may make; (vi) furnish technical notices, updates, security alerts, and support and administrative messages to you; (vii) personalize our Services, including providing features, announcements, notifications, and advertisements related to your interests and preferences; (viii) provide service announcements or transactional messages; (ix) investigate and prevent fraudulent transactions, unauthorized access to or use of our Services and other illegal activities; (x) assess the level of general interest in the Services, (xi) process and deliver contest or sweepstakes entries and rewards and (xii) for any other purpose with your consent.

5. SHARING INFORMATION; THIRD-PARTY DISCLOSURES:

We may share your personal information with certain organizations and third parties in accordance with applicable law, including as set out below. However, we do not share personal information with third parties that we have reason to believe use such information for their own direct marketing purposes. Some organizations and third parties may be located outside of your home country and by using the Sites, you consent to the transfer of such information to them. In the event that you facilitate a transaction with BoxCast, or request information from or otherwise engage with us, and such activities require BoxCast to share your personal information with a service provider or other third party, you hereby consent to such disclosure and/or direct BoxCast to intentionally disclose your personal information to the service provider or third party.

Service Providers. We may share your personal information with companies that provide services on our behalf, such as hosting and analyzing the Sites, conducting surveys and marketing on our behalf, processing transactions (including rebates and returns), tracking and responding to consumer questions or complaints, and performing analyses to improve the quality of our Services.

Business Partners. We may share your personal information with third parties that distribute our products and marketing materials.

Business Restructuring. Circumstances may arise where, for strategic or other business reasons, BoxCast decides to sell, buy, divest, merge or otherwise reorganize our businesses. We may disclose your personal information to the extent reasonably necessary to proceed with the negotiation or with the completion of a merger, acquisition, divestiture or sale of all or a portion of BoxCast’s assets.

Legal Requirements and Legitimate Interests. We may disclose personal information when we believe such disclosure is appropriate or necessary to: (i) comply with applicable law and legal processes; (ii) respond to requests from public and government authorities, including public and government authorities outside your country of residence; (iii) enforce a contract with us; (iv) protect our rights, privacy, health, safety, or property, and/or that of our affiliates, you or others; and (v) allow us to pursue available remedies or limit the damages that we may sustain.

Other Disclosures. We may disclose your personally-identifying information if you expressly consent to the disclosure. We may disclose non-personally identifiable aggregated information about our users without restriction.

Custom App Specific Disclosures: If you use Custom Apps administered by a particular church and you submit a prayer request or other information to be viewed by the church, such information will be shared with and visible to the church that is administering the Services to be used by the church without restriction. Please only submit prayer requests or other information that you are comfortable disclosing to an administering church in accordance with this section.

6. VIRTUAL ASSISTANTS/AI AGENTS:

BoxCast employs virtual assistants powered by third-party artificial intelligence (AI) and automated processing to facilitate administrative and service-related activities. The assistant is designed to (i) analyze user input using natural language processing, (ii) match user questions with appropriate responses from a knowledge base, and (iii) automatically record and store communications for compliance, audit, and quality assurance purposes in accordance with applicable data protection laws and this Privacy Policy, and (iv) deliver information about our services, provide technical support, and answer questions about your account. You should not submit confidential, privileged, or sensitive information through our virtual assistants. No information from an assistant creates any warranty or modifies any BoxCast policy including this policy or our Terms of Use.

7. SOCIAL MEDIA:

We may engage with you on various social media platforms. If you contact us on a social media platform for customer support or for other reasons, we may contact you via the social media’s direct message tools. Those communications to and from us are governed by this Privacy Policy. However, your use of a social media platform is also subject to the policies and terms of the relevant social media platform. Certain social media platforms may also automatically provide us with your personal information, and the information we receive will depend on the terms that govern your use of the social media platform(s) and any privacy settings you may have set. The Site may include social media features and widgets or interactive mini-programs that run on the Site. These features may collect your IP address and which Site page you are accessing and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the Site. Your interactions with these features are governed by the privacy policies of the relevant social media platform that provides them.

8. LINKS TO OTHER WEBSITES; YOUR DIRECT THIRD-PARTY DISCLOSURES:

As a resource to you, the Site may include links to third-party websites or provide you the opportunity to disclose information directly to third parties (e.g., credit card processors). Our Privacy Policy does not apply to such third-party websites or organizations. You assume all privacy, security, and other risks associated with providing any data, including personal information, to third parties via the Services. For a description of the privacy protections associated with providing information to third parties, you should refer to the privacy policies, if any, provided by those third parties.

9. PUBLICLY POSTED INFORMATION:

The Sites may provide you with the ability to submit a comment on, provide an opinion about, rate, or otherwise discuss our Services or provide other information (“Feedback”), and such Feedback may be posted to a publicly available portion of the Sites. Any information or content you post in your Feedback may be available to other users of the Site (and our social media platforms, if any) and may be retrievable by third-party search engines, and third parties may also be able to download or share your Feedback to social media websites or elsewhere. We recommend that you guard your privacy and anonymity and not upload any information in your Feedback that you wish to remain confidential. Any third party with access to your information via the Sites will be permitted to use the information in the same manner as if you submitted the information directly to that third party. Publicly posting any information on the Sites is entirely voluntary on your part, and we recommend you carefully consider the information you choose to make publicly available. In order for us to utilize such Feedback, you grant to us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license, with the right to sublicense, under all relevant intellectual property rights, to use, publish, and disclose such Feedback in any manner we choose and to display, perform, copy, make, have made, use, sell, and otherwise dispose of BoxCast and our sub-licensees’ products or services embodying such Feedback in any manner and via any media we choose, without reference to the source. BoxCast shall be entitled to use Feedback for any purpose without restriction or remuneration of any kind with respect to you and/or your representatives.

10. YOUR RESPONSIBILITIES:

You are permitted, and hereby agree, to only provide personal information to BoxCast if such personal information is accurate, reliable, and relevant to our relationship and only to the extent such disclosure will not violate any applicable data protection law, statute, or regulation. IF YOU PROVIDE PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO BOXCAST, YOU EXPRESSLY REPRESENT AND WARRANT TO BOXCAST THAT YOU HAVE THE FULL RIGHT AND AUTHORITY TO PROVIDE BOXCAST WITH SUCH PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) AND THAT BOXCAST’S USE AND PROCESSING OF SUCH PERSONAL INFORMATION AS SET FORTH HEREIN WILL NOT VIOLATE ANY PERSON’S RIGHTS OR PRIVILEGES, INCLUDING RIGHTS TO PRIVACY. YOU HEREBY AGREE TO FULLY AND COMPLETELY INDEMNIFY BOXCAST FOR ANY CLAIMS, HARM, OR DAMAGES THAT MAY ARISE FROM YOUR PROVISION OF PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO BOXCAST.

11. U.S. RESIDENTS PRIVACY RIGHTS:

You may have certain rights under applicable state data privacy laws with respect to personal information about you that is collected through the Sites or when you contact or otherwise engage with us. The exact scope of rights varies by state but may include the following:

Right to Know: The right to know about what personal information BoxCast collects about you, and our intended use of, and purposes for collecting, your personal information. The personal information that we collect from you, the purposes for which it is used, the source of such personal information, and the parties to whom we share your personal information, among other issues, are set forth in this Privacy Policy.
Right to Access: The right to access general categories and/or the specific pieces of personal information we have collected, used, disclosed, or sold about you over the past twelve (12) months, including the sources from which the personal information was collected; the business or commercial purpose for which your personal information was collected, used, disclosed, or sold; and, the third parties with whom we have shared your personal information.
Right to Correct: The right to have your personal information corrected in case of inaccuracy or incompleteness. Upon request, we will correct inaccurate personal information about you and, taking into account the purposes of the processing, update any incomplete personal information, which may include the provision of a supplementary statement.
Right to Delete: The right to request that we delete/erase your personal information under certain circumstances.
Right to Opt Out of Sharing/Targeted Advertising: The right to opt out from having us disclose your personal information to third parties for targeted advertising purposes. This is sometimes referred to as the right to opt-out of the “sharing” of personal information for cross-contextual behavioral advertising purposes.
Right to Opt Out of Sale of Personal Information: Nevada residents may submit a request directing us to not sell personal information we maintain about them to third parties who will sell or license their personal information to others. BoxCast does not engage in the sale of personal information as defined by applicable privacy laws.
Right of Data Portability: The right to request that we transfer, to the extent technically feasible, personal information in certain forms and formats.
Right to Nondiscrimination: The right not to be subject to discrimination for asserting your rights.

Submit a Privacy Request. To exercise any of these data privacy rights, please contact us, or have your authorized agent contact us, in accordance with the “Contact Us” section listed below. In the event you submit, or your authorized agent submits on your behalf, a data request, you (and your authorized agent) hereby acknowledge and agree, under penalty of perjury, that you are (or the authorized agent of) the consumer whose personal information is the subject of the request. We will respond to any data requests within the timeframes required by law, and we may charge a fee to facilitate your request where permitted by law.

Privacy Request Verification Process. If you make, or an authorized agent on your behalf makes, any request related to your personal information, BoxCast will ascertain your identity to the degree of certainty required under applicable law before addressing your request. BoxCast may require you to match at least three pieces of personal information we have previously collected from you before granting you access or otherwise responding to your request. We may require written documentation that demonstrates a third party is authorized to serve as your agent for the purposes of submitting the requests set forth herein, unless you have provided the authorized agent with power of attorney in compliance with applicable law. None of these rights are absolute and are subject to legal and regulatory exceptions and exemptions.

12. EUROPEAN RESIDENTS PRIVACY RIGHTS:

When BoxCast is acting as a data controller, we will honor privacy requests as required by applicable law. For individuals in the European Economic Area (EEA), Switzerland, and the United Kingdom, you are entitled to the following privacy rights:

Right to Know. You may have the right to know about what personal information BoxCast collects and processes about you, including the types of personal information we collect and process, the sources of such personal information, our retention criteria, with whom we share your personal information, cross-border data transfers, and how to file complaints and inquiries.
Access Rights. You may have the right to ask us whether we process any of your personal information and, if so, receive access to such personal information. When complying with an access request, we will also provide you with additional information, such as the purposes of the processing, the categories of personal information concerned as well as any other information necessary for you to exercise the essence of this right.
Rectification. You may have the right to have your personal information corrected/rectified in case of inaccuracy or incompleteness. Upon request, we will correct inaccurate personal information about you and, taking into account the purposes of the processing, update any incomplete personal information, which may include the provision of a supplementary statement.
Erasure. You may have the right to have your personal information erased, which means the deletion of your personal information by us. However, your right to erasure is subject to statutory limits and prerequisites (e.g., where your personal information is no longer necessary in relation to the initial purposes for which it was processed, your personal information was processed unlawfully).
Restriction of Processing. You may have the right to obtain the restriction of the processing of your personal information, which means that we suspend the processing of your personal information for a certain period of time. Circumstances which may give rise to this right include situations where the accuracy of your personal information is contested, but we need time to verify the inaccuracy (if any) of your personal information.
Data Portability. You may have the right to request we provide you with your personal information in a structured, commonly used and machine-readable format and to have such data transmitted directly to another controller, where technically feasible.
Right to Object. You may have the right to object to the processing of your personal information, which means you may request we no longer process your personal information. This only applies in case the “legitimate interests” ground (including profiling) constitutes the legal basis for processing (see below “Legal Basis for Processing”). However, at any time (and free of charge) you can object to having your personal information processed for direct marketing purposes.
Automated Decision Making. You may have the right to object to having us use your personal information to conduct automated decision making. However, BoxCast does not engage in any activity that subjects our customers, website users, survey participants, or others to a decision based solely on automated processing, including profiling, which produces legal effects, or similarly significant results, impacting them.
Withdrawing Consent. You also may withdraw your consent at any time if we are solely relying on your consent for the processing of your personal information. However, this will not impact our legal basis to process such personal information prior to the withdrawal of your consent.

Legal Basis for Processing. For purposes of the EU/UK GDPR, we can collect and process your data under one of the following legal bases:

Consent. We can collect and process your data with your consent. For example, if you have given your consent to receive marketing material from us at the point we collected your information.
Contractual Obligations. We need your personal information to comply with our contractual obligations. For example, if you have subscribed to one of our services, we use your personal information to fulfill and deliver that service to you.
Legal Compliance. If the law requires us to, we may need to collect and process your data.
Legitimate interest. We may use your data as required in the normal course of operating our businesses and services unless our legitimate interests are overridden by your rights.
Vital interests. We may need to process your personal information if the processing is necessary to protect your vital interests (for example, health and safety reasons if you attend a meeting at a BoxCast location).

Complaints. Depending on applicable law, you may have the right to submit a complaint to a data protection authority responsible for overseeing our compliance with data protection law in your jurisdiction. Please see a list of potentially applicable regulatory authorities:

We would, however, appreciate the opportunity to address your concerns, so please feel free to contact us regarding any complaint you may have. We will not discriminate against individuals for exercising their data privacy rights or filing a privacy complaint.

13. MARKETING PREFERENCES:

You have the right to opt out of receiving electronic direct marketing communications from us. All electronic direct marketing communications that you may receive from us, such as e-mail messages, will give you an option of not receiving such communications from us in the future. You may utilize third-party tools available from the Digital Advertising Alliance and the Network Advertising Initiative. Because these opt-out tools are device and browser-specific, you must repeat the opt-out process from each of your browsers and devices.

14. DO-NOT-TRACK SIGNALS:

Some web browsers may transmit “do-not-track” signals to the sites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

15. PERSONS WITH DISABILITIES:

BoxCast strives to ensure that every person has access to information related to our Services, including this Privacy Policy. Please contact us in accordance with the “Contact Us” section listed below if you would like this Privacy Policy provided in an alternate format, and we will seek to meet your needs.

16. EMPLOYMENT APPLICATIONS AND TALENT MANAGEMENT:

As part of our recruitment and talent management process, we collect personal information with respect to individuals who are interested in working for us. In this context, we collect employment and application data, such as the following: contact information (e.g., name, title, residential or postal address, telephone number, and personal email address); information in a curriculum vitae, resume, cover letter, or similar documentation; details regarding the type of employment sought, willingness to relocate, job compensation and benefit preferences; health data (e.g., medical conditions); information related to your background, education, criminal record, credit history and similar data; information provided about or by your references or other third parties related to your employment history, skills, qualifications, or education; and information related to previous applications to us or previous employment history with us. When permitted by law, we may collect information about your race and ethnicity to assist with our inclusion programs. We use this information for the following purposes: to identify and evaluate job applicants; to verify your information; to complete employment, education, background and reference checks; to communicate with you about the recruitment process and your application; to comply with our legal, judicial, regulatory, administrative, or other corporate requirements; to analyze and improve our application and recruitment process; to accommodate individuals who may have specialized needs during the employment process; and to protect the rights, interests, and property of our business, other job applicants, employees, or the public, as required, or permitted, by law. We may share this personal information with third parties (see “Sharing Information / Third-Party Disclosures”), and we may also use this employment and application data for any other purpose set forth in this Privacy Policy.

17. ACCESSING, DELETING, AND CORRECTING YOUR INFORMATION:

We may not be able to delete your personal information without also deleting your user account.
